WAIVER OF CLAIMS

I, the undersigned,

identity number :

hereby acknowledge that I have been informed as follows:

1. There are wild animals roaming Le Coeur Volant. These include snakes, birds, insects, zebra and various species of antelope.

2. The abovementioned animals are unpredictable, and it cannot be guaranteed that they will not react to the presence of myself or of other persons walking about Le Coeur Volant, and that they may not attack those persons.

3. Although there are well-demarcated paths and roads on Le Coeur Volant, these are uneven in places, and it is possible that persons moving about upon them may lose their footing, stumble and fall, and become injured.

4. There are various species of venomous snakes, birds, insects, zebra and various species of antelope on Le Coeur Volant. It is possible that persons moving about Le Coeur Volant may come into contact with these, and be hurt, bitten, kicked or stung.

5. Included in the facilities offered by Le Coeur Volant is a swimming pool. There are no life-saving facilities offered to persons making use of the swimming pool.

In the full knowledge of what is set forth above, I hereby waive all and any rights whatsoever which I might have had under any circumstances whatsoever to claim compensation or any other relief whatsoever from Le Coeur Volant, its proprietors, or from the owners of the property upon which it is situated, their associates, servants and employees and/or any person connected whether directly or indirectly with the running of the lodge and fellow guest/invitee arising from any cause whatsoever and whether on the basis of negligence, gross negligence, intentional act or in contract intending by means of this waiver to free the abovementioned persons from any responsibility, howsoever arising, for the sequelae of any event which might occur involving myself whilst I am upon the property upon which Le Coeur Volant is situated.

In addition to the abovementioned waiver, I hereby indemnify Le Coeur Volant, its proprietor and the owner of the abovementioned property, their associates, servants and employees and/or any person connected whether directly or indirectly with the running of the lodge and fellow guest/invitee in respect of any claim which may be brought against all or any of them, howsoever arising, by any minor person whom I might accompany on any visit to Le Coeur Volant, or to the property in question. In the event that any such claim is instituted by any minor as envisaged above, then, whether I am, in law, responsible for the maintenance of such minor or not, I irrevocably and in rem suam authorise Le Coeur Volant, on my behalf, and acting in my stead to appoint attorneys of their choice to defend such action, hereby, on demand, undertaking to do all such things as may be necessary to enable such attorneys properly to defend the actions concerned, in their discretion. I undertake, on demand, to pay to the attorneys in question such amounts as may be due to them in respect of their fees and disbursements, such fees and disbursements to be calculated on a scale as between attorney and own client in respect of all work carried out by these attorneys on the instructions of Le Coeur Volant, for the abovementioned purposes.
